Washington Consumer Health Data Privacy Notice

This Washington Consumer Health Data Privacy Notice (this “Privacy Notice”) is intended to supplement our Privacy Policy and applies only to Washington residents. Any terms defined in the MJH Privacy Policy have the same meaning when used in this Privacy Notice.
Application
This Privacy Notice applies only to https://www.theeducatedpatient.com/ and https://www.curetoday.com/ (the “Sites”).
This Privacy Notice applies solely to Washington consumers who interact with us in an individual or household capacity and applies only to personal information defined as “Consumer Health Data” subject to the Washington My Health My Data Act (the “MHMD Act”).
This Privacy Notice describes what Consumer Health Data we collect, how we collect and use it, who we disclose it to and why, and the rights you may have regarding our use or disclosure of your Consumer Health Data.
Categories of Consumer Health Data We Collect
Consumer Health Data is a subset of personal information and is defined under the MHMD Act as “personal information that is linked or reasonably linkable to a consumer and that identifies the consumer’s past, present, or future physical or mental health status.” Consumer Health Data does not include publicly available information or personal information that has been deidentified. Examples of Consumer Health Data are provided below.
We may collect or receive the categories of Consumer Health Data listed below. Our collection of Consumer Health Data depends upon your navigation of the Sites and the information that you provide to us. Not all categories of Consumer Health Data will be collected or received for every individual.
- Individual health conditions, treatment, diseases, or diagnosis;
- Information identifying health-related surgeries or procedures;
- Information identifying use or purchase of prescribed medication;
- Information identifying bodily functions, vital signs, or symptoms;
- Information identifying diagnoses or diagnostic testing, treatment, or medication;
- Reproductive or sexual health information;
- Information that identifies an individual’s intention to seek health care services; and
- Information that we derive or extrapolate from data that is not Consumer Health Data and then use to associate an individual to the information listed above
Categories of Sources from which We Collect Consumer Health Data
The following are categories of sources from which we may collect Consumer Health Data:
- directly from you when you complete any webforms available on the Sites (e.g., sign up for eNewsletters, magazines, webinars, or otherwise indicate interest in any particular health condition, treatment, disease, or diagnosis);
- directly from you when you otherwise submit information to us (e.g., submission of blog posts, personal stories, etc.);
- from information collected through the use of cookies, web beacons, and other tracking technologies within the Sites; and
- from third parties that assist us in providing relevant services.
Use of Your Consumer Health Data
We may collect the Consumer Health Data listed above for the following purposes:
- To respond to your questions;
- To confirm or fulfill registration or subscription requests;
- To provide to you the services, subscriptions, or information you requested;
- To target advertising and marketing communications to your interests and geographic location;
- To get your feedback to assess user-satisfaction or other needs and interests;
- To perform information analysis, compliance audits, and data metrics;
- To evaluate the use and the effectiveness of the services that we offer which can include the effectiveness of content, advertising or programs;
- To help us create new tools, features, and services and improve our Sites, content, and Services;
- To perform security and integrity tasks, including detecting security incidents and protecting against malicious, fraudulent, or illegal activity;
- To comply with applicable laws, rules, or regulations in operating our business;
- Otherwise in rendering, administering, and improving the Site, our Services, and our business; and
- For other purposes with your consent.
Sharing Consumer Health Data with Third Parties
As necessary for the purposes described above, we may share the categories of Consumer Health Data set forth above, with the following categories of third parties:
- * We may enable access to data across our subsidiaries, affiliates, and related companies, for example, where we share common data systems or where access helps us to provide our services and operate our business.
- Service providers or processors. Vendors or agents working on our behalf may access Consumer Health Data for the purposes described above (e.g., we may share Consumer Health Data with our data warehouse vendor in order to maintain the Sites and may share Consumer Health Data with a vendor that tracks usage metrics of the Sites).
- Government agencies. We disclose data to law enforcement or other government agencies when we believe doing so is necessary to comply with applicable law or respond to valid legal process.
- Third parties for marketing purposes. We disclose certain device information and information regarding your usage of the website with third parties for marketing purposes.
- Third parties involved in business transfers. For example, for a corporate merger, acquisition, consolidation, the sale of substantially all of our assets, or other fundamental corporate change, whatever form it may take.
- Other third parties. In certain circumstances, it may be necessary to provide data to other third parties, for example, to comply with the law or to protect our rights or those of our customers.
We do not “sell” Consumer Health Data for monetary or other valuable consideration.
How to Exercise Your Rights
The MHMD Act provides certain rights with respect to Consumer Health Data subject to certain exceptions. If you are a Washington resident, you may have the right to: (1) request access to your Consumer Health Data; (2) request that we confirm whether we have collected, shared, or sold your Consumer Health Data; (3) request a list of all third parties and affiliates with whom MJH has shared or sold your Consumer Health Data and an active email address or other online mechanism that you may use to contact these third parties; (4) request that we delete your Consumer Health Data; and (5) withdraw your consent relating to our collection and sharing of your Consumer Health Data.
You may exercise any of your rights by contacting us directly using the contact details found in this Privacy Notice. The written request should include sufficient information to verify your identity and specify the right you wish to exercise. For any questions or assistance relating to exercising your rights under the MHMD Act, you may also contact us at the information listed below.
If your request to exercise a right under the MHMD Act is denied, you may appeal that decision by contacting us at the contact information listed below. If your appeal is unsuccessful, you may file a complaint with the Washington State Attorney General at www.atg.wa.gov/file-complaint.
Changes to this Privacy Notice
We reserve the right to update this Privacy Notice from time to time, such as when there are changes in our services, changes in our data protection practices, or changes in the law. When changes to this Privacy Notice are significant, we will inform you through this webpage.
